In this case,if your mother receives the gifts exceeding $100K per year, then, she must file Form 3520. In general, Form 3520 is due on the date that your income tax return is due. A penalty generally applies if Form 3520 is not timely filed or if the information is incomplete or incorrect. Generally, the initial penalty is equal to the greater of $10K or: 35% of the gifts amount. In general, you don’t have to pay tax on the gifts from Korea.

The federal government expects that your father will provide financial support to you while you are in college. Therefore, the FAFSA requires that you include your father's financial information, including his income. When the government calculates the expected family contribution, it assumes your father will be contributing part of your income and assets. ALSO, in some cases, you do not have to report your parents' income on the FAFSA if you are an independent student in the eyes of the federal government.
