Re: Deposit Return of $1,700 plus $300

I'm writing this letter to demand you to return my deposit of $1,700  which was paid to you for lease agreement dated August 25th,2007.

According to our agreement regards to lease space located (Address) dictates that you've commited to have the space ready for us to move in by September 15th,2007 , however not only the space was not ready but continue delayed due to slow reconstruction to expand more space.

You've verbally convinced us to elaborate renovation to lease the space specifically to accomodate us but in reality, you had plan to reconstruct to expand instead of renovation to create just one leased space for us.

Reconstruct or renovation may be your option since it is your real property but we, my pregnant wife and I should not be jeopardized nor put on disadvantageous position by misleading informations.

Proposed lease space is not ready even up todate with many irresponsible excuses and we can't afford to wait any longer due to expecting my wife's delivery .

You've aknowledged your fault and issued your personal check amount of $1,700 dated on ________and requested me to deposit it 10 days later.

I have attempted to cash your check several times but account was insufficient to cover the check amount therefore I've deposited  the check into my checking account and found out that you made "stop Payment"on it.

Your bad check caused not only bank over draft charges but placed us in financial bind as well.

Your act of stop payment on issued check is a clear fraudulent intention and you can be indicted for perjury and proscuted as misdemeanor.

I also intend to file a small claim against you for financial and punitive damages that you caused.

I will patiently wait next 10 days for you to redeem your mistake and pay $1,700 plus $300 for interest and distress charge, in form of casher's check only and mail to us.

I will not tolerate your unlawful intention any further regard to this matter and I will protect my interest vigorously.
